1. Who We Are

Welcome to Penny!  We are an Australian business (ABN: 17 666 556 181) based in Sydney, Australia.

We’re here to support women on their journey to buying their first home by providing information, resources, coaching, and referrals to trusted professionals to help women navigate the home buying process. 

These Terms and Conditions explain how our services work and what you agree to when you use them. If you have any questions, feel free to reach out to us.

2. What We Offer

When you sign up for our services, you may get access to:

2.1 Educational Content and Tools

General information, resources, checklists, calculators, courses, templates and guides relevant to personal finance, financial wellbeing and the home-buying process. All content is general in nature and does not take into account your personal objectives, full financial situation or needs.

2.2 Personalised Home-Buying Plans

Support to help you organise your information, understand the steps involved in purchasing a property, and create a personalised plan or roadmap.

Plans are for guidance only and are not financial or credit advice.

2.3 General Guidance and Coaching

One-to-one or group sessions focusing on education, behavioural support, accountability and facilitating informed decision-making. These sessions are educational and supportive in nature.

They’re not a substitute for professional financial, legal, or real estate advice. They may be delivered online via video call or in person, depending on availability. We ask that you provide at least 24 hours’ notice if you need to cancel or reschedule. Missed sessions without notice may not be refundable.

Sessions do not involve assessing borrowing capacity, providing product recommendations, or advising on financial or credit products from Penny employees.

2.4 Facilitated introductions to Third-Party Professionals

Introductions to independent financial advisers, mortgage brokers, accountants, buyer’s agents, conveyancers, utilities providers and other service providers (“Partners”).

By using our referral services, you consent to sharing your information, including your full name and contact details, with your chosen Service Provider.

Penny does not act as an agent for you or the Partner. Penny does not guarantee the quality, performance, licensing, costs or suitability of any Partner. Any relationship, contract or service agreement is strictly between you and the Partner.

2.5 Professional Quote Review Support

Assistance to help you understand and compare quotes provided by Partners.

Information is general only and not an endorsement or assessment of suitability. Penny does not negotiate on your behalf.

2.6 Check-ins and Accountability Support

Regular check-ins designed to help you stay on track with your home-buying goals. These are educational and motivational in nature and do not involve regulated financial, credit or legal advice.

2.7 Access to Penny’s Technology Platform and Features

Use of the Penny app, dashboards, progress-tracking tools, notifications, calculators and community features. Feature availability may vary depending on subscription type.

3. What we do not offer

3.1 To avoid doubt, Penny does not:

  • Provide financial advice, credit advice, tax advice, legal advice or real estate advice.
  • Assess suitability of financial products, recommend or compare specific financial products.
  • Act as a mortgage broker, financial adviser, real estate agent or conveyancer.
  • Complete or submit loan applications on your behalf.
  • Guarantee loan approval, property outcomes, availability of government grants, or market performance.
  • Take responsibility for the acts, omissions, advice or services of Partners.

4. Your use of our Services

4.1 Use of our Referral Services

This allows us to offer and maintain our platform and referral services for free, in line with our mission to make tailored financial services more accessible to women.

These arrangements do not affect the independence of our educational content or the user’s right to choose their own providers.

4.2  Use of Referral Services at Your Own Risk

You are responsible for assessing the suitability and risks of engaging any Service Provider. You are advised to conduct your own independent research before engaging their services.

4.3 Independent Relationships with Service Providers

Any agreement, contract, or transaction you enter into with a Service Provider is solely between you and that Service Provider. Penny is not a party to any such agreement and is not responsible for the terms, conditions, or outcomes.

4.4  No Endorsement or Guarantee

While we work with reputable Service Providers and conduct due diligence, Penny does not guarantee the quality, accuracy, or reliability of their services. Any opinions, advice, or recommendations expressed by Service Providers are their own and do not reflect Penny’s views.

4.5 Limitation of Liability

Penny is not liable for any loss, damage, or expense arising from or in connection with your use of any Service Provider’s services. Any disputes must be resolved between you and the Service Provider.

4.6 Referral Service Disclaimer and Consent

By using our referral service, you consent to share your personal information, including your name, contact details, and details of the services you are seeking, with the Service Provider you select. Once engaged, your relationship is solely with the Service Provider. It is your responsibility to review and independently assess the suitability and terms of service of any Service Provider you choose to work with. For further details, please refer to the individual Service Provider’s terms of service and agreements.

4.7 Use of our Coaching Services

We don’t provide financial, legal, or tax advice. Our content is general in nature and for educational purposes only. Before making any decisions, we recommend speaking with a licensed financial adviser, mortgage broker, or legal professional.

5. Payments and Subscriptions

Some of our services are free, and others are paid. We’ll always clearly explain what’s included, how much it costs, and how to cancel. All prices are in Australian dollars and include GST unless stated otherwise.

6. Refunds and Guarantees

We follow Australian Consumer Law. If something you’ve paid for doesn’t work as promised, let us know – you may be entitled to a refund or replacement. We don’t offer refunds just because you change your mind, but we’ll always try to help.

7. Community Guidelines

We want our community to be a safe and supportive space. Please be respectful, kind, and constructive. We may remove content or suspend accounts that don’t follow these values.

8. Intellectual Property

All content we create – including guidebooks, tools, and coaching materials – belongs to us. You’re welcome to use it for personal use, but please don’t copy, share, or sell it without our permission.

9. Changes to These Terms

We may update or amend these Terms of Sale from time to time to reflect changes in our business practices, legal requirements, or other relevant circumstances. Any changes will take effect when published on our website. Your continued use of our website or purchase of products after such changes constitutes your acceptance of the updated Terms. Nothing in this clause limits your rights under the Australian Consumer Law.

10. Limitation of Liability

We do our best to provide helpful, accurate information, but we can’t guarantee everything will always be perfect. We’re not liable for any loss or damage from using our services, except where the law says we must be.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in the courts of New South Wales.

12. General Terms

12.1 This agreement does not create an employment, agency, partnership, or joint venture relationship.

12.2  If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
